EXIMIOUS FLYING CLUB -- OPERATING RULES

- DOCUMENT PURPOSE
This document establishes the rules and regulations covering the use of aircraft and equipment owned by Eximious Flying Club, Inc.. These rules and regulations shall apply to all Eximious Flying Club, Inc. members. Determination of the intent of these rules and regulations shall be made by the Eximious Flying Club, Inc. Executive Board, should a case arise where their intent is not clear.
- ELIGIBILITY
- Regular Members
All of the Club's aircraft are available for the use of Active Regular Members subject to the restrictions listed in the paragraphs below.
- Associate Members
The Club has established the Associate Member category of membership to encourage the spouse or children (up to age 21) of regular members to obtain a private pilot's license. A non-refundable $50.00 fee (which may be applied toward a Regular Membership), along with monthly dues equal to one-half the Regular membership dues entitles the Associate member to all the rights and privileges of a Student Pilot. The Associate Member must become a Regular Member, or drop out of the Club, upon completion of his or her private pilot curriculum. Debts incurred by the Associate member are the responsibility of the related Regular Member. The Club reserves the right to limit the number of Associate Members.
- Student Pilots
Student Pilots will be restricted to use of the Club designated training aircraft. The Executive Board may approve use of Club aircraft other than the designated training aircraft for primary student training.

- AIRCRAFT OPERATIONS
- Applicability – Members
Flight operations rules apply to all members.
- Applicability – Students
Where student rules differ, they are specifically stated.
- Civil Air Regulations
Members shall observe all existing Federal, State, Local and Airport rules and Regulations.
- Commercial Operations
The use of Club aircraft for commercial operation is prohibited.
- Operation by Non-Members
Club aircraft shall not be flown by persons other than active Club members, unless a Club member occupies a flight position in the aircraft and is rated for the conditions of flight. The Club member retains the responsibility for the operation of the aircraft under all conditions. Non-members may be authorized to operate the aircraft by the Operations Officer.
- Airports
The aircraft shall be operated only to/from public or private airports designated as such by the appropriate civil authority.
- Aerobatics
All aircraft shall be operated under the limitations as described in the Pilot's Operating Handbook. Inverted flight is prohibited in all aircraft.
- Night Flying
A logged night flying check ride by a licensed instructor is required for a member to conduct flight operations between the hours of civil twilight and civil daybreak. Flying into or out of unlighted fields at night is prohibited.
- Smoking
Smoking is prohibited in all aircraft.
- New members
New members, regardless of ratings or experience, will check out in each Club type and make of aircraft they wish to fly, with a Club approved instructor before being approved for flight in that aircraft. This checkout shall be recorded in the member's logbook.
- Flight Outside Continental U.S.
Permission of the Club Executive Board and the Club's aircraft insurer is required for all flights outside the continental U.S., with the exception of flights in Canada.
- Student Members
- Instruction
Student members are required to use a Club approved instructor.
- Weather
Minimum weather for student solo cross-country flights shall be 3000 feet minimum en route ceiling, 5 miles minimum visibility, and improving.

- Storage
All aircraft are to be locked and properly tied down (with appropriate gust locks in place) or hangared when not in use.
- Fueling
All aircraft are to be fueled to no less than the equivalent of tabs before returning the aircraft to its storage point.
- Flight Log
The aircraft flight log shall be properly filled out by the member at the conclusion of the scheduled flight. (Placing entries in the log for every day of an extended trip is unnecessary.) This information shall include any maintenance performed, any aircraft malfunction, any aircraft damage, and the addition of oil to the aircraft engine.
- Preflight
The member shall perform a careful preflight of the aircraft before each flight, being sure to check the aircraft log for reports of aircraft equipment malfunction.
- Maintenance Problems
Any member discovering aircraft maintenance problems which may render the aircraft unsuitable for further use shall post a conspicuous notice in the aircraft, log these problems, and report them to the Club Operations Officer or the Plane Captain.
- New Aircraft
Any newly-acquired aircraft will not be released to the membership until completion of test flights satisfactory to the Operations Officer.
- Return of Aircraft
It is the responsibility of the member to return the aircraft to its usual base airport.
- Member Currency
Members shall assume the responsibility of maintenance and determination of currency under the FAR's. In addition, a member who has not flown in a club aircraft in the preceding ninety (90) days shall be considered non-current until completing a check out in a Club aircraft with a Club approved instructor.
- Operation by Non-Current Member
If a club member flies a club aircraft while not current, he/she will be fined $100.00 for the first offense. A second offense will result in expulsion from the club.

- SCHEDULING
- Reservations
All aircraft must be scheduled with the Internet based computer scheduling system before use. If your currency has expired, booking can be done through the Vice President only. Inform the Vice President of the time and date that you wish to use the aircraft with your flight instructor to return to currency.
- Cancellation
Scheduled time must be canceled whenever a flight is canceled or terminated early for any reason.
- Duration
Aircraft may be scheduled for any period up to and including seven consecutive days. Exceptions to the above must be approved by the Club Executive Board.
- Minimum Chargeable Time
Aircraft scheduled for a period exceeding 24 consecutive hours will be charged at a minimum rate of one hour per day on weekdays or two hours per day on weekends.
- Returning Late
Members whose scheduling is being delayed or usurped by the late return of an aircraft will be informed of the situation by the late-arriving member, who shall report the reason for the delay and the anticipated return time.

- Dues
Members will be charged a monthly dues which is payable in advance.
- Flying Fee
Members will be charged at the appropriate hourly rate for the tachometer times logged in each aircraft during the month preceding the billing month.
- Late Payment Charge
A late payment charge of 2% of the unpaid balance will be added the first month to any bill not completely paid by its due date, and a charge of 10% will be added for each succeeding month until the bill is paid in full.
- Aircraft Damage
Members are liable for up to 100% of the deductible portion of the aircraft insurance for any aircraft damage caused by improper operation or parking of the aircraft. The Executive Board will make determination of the extent of the liability. In cases of gross negligence, the Board after full and fair consideration may determine the liability for the damage is the full responsibility of the member and may seek reimbursement accordingly.
- Equipment Damage
Damage or loss of Club equipment due to the carelessness of a member will be charged 50 to 100% of the replacement cost of that equipment. The Executive Board will make determination of the extent of the liability.
- Failure to Cancel Reservation
A member failing to cancel reservation or a portion of a reservation which is not used will be fined at a rate of one dollar per hour of time scheduled and not used, up to the maximum fine equal to the minimum daily rate charged and not used.
- Violations of Rules
Violation of the Club rules by a member renders him liable to either a fine, temporary suspension, or both. Expulsion from the Club will be recommended in extreme cases of violation of Club rules.
- Costs of Aircraft Operations
- Fuel, Oil, Minor Maintenance
Fuel, oil, and minor maintenance charges are to be charged on the Club's credit cards, which are located in each aircraft. In the event an acceptable credit card is not available, the charge should be paid by the member and a suitable receipt presented to the Treasurer, along with the following month's Club payments. Minor maintenance is defined as those items (lights, strut inflation, etc.) for which the cost does not exceed $100.00.
- Major Maintenance
Members (other than the Operations Officer or Plane Captains) shall not authorize major maintenance (charges exceeding $100.00) on any aircraft, unless the aircraft is away from its home base and this maintenance is necessary for continued safe operation. Approval forms for the explanation of this maintenance are included in each aircraft. The Club reserves the right to disallow payment for maintenance which the Executive Board considers to be unnecessary or capricious.

Use fees such as tie down, landing fees, thawing, etc. will be borne by the member and are not to be charged on the Club's credit cards.
